Medical Treatment
Lawsuits related to medical treatment are triggered by a number of causes, including failure to select the correct treatment or to monitor or follow up on the patient's condition.
Medical negligence
Failure of a physician or other medical personnel to meet the standards of conduct for duties relating to the medical profession. Those standards are based on what a reasonable person with the requisite knowledge and skills would or would not do.
Negligence
Failure to exercise that degree of care that a reasonable person would exercise under the same circumstances. When that failure causes another person to suffer an injury or financial loss, that person may be entitled to just compensation through our civil justice system.
Allodynia
When pain is caused by something that does not normally cause pain (such as clothing touching the skin).
Medications Malpractice
This category covers claims arising from inaccurate medication prescriptions, such as wrong medication or dosage level.
Statute of limitations
A statute specifying the period of time after the occurrence of an injury--or, in some cases, after the discovery of the injury or of its cause--during which any suit must be filed.
Brain death
Irreversible cessation of cerebral and brain stem function; characterized by absence of: electrical activity in the brain, blood flow to the brain, and brain function as determined by clinical assessment of responses.
Duty of Care
Once a doctor or health care professional agrees to diagnose or treat a patient, he or she has assumed a duty of care toward that patient.
Economic damages
Funds to compensate a plaintiff for the monetary costs of an injury, such as medical bills or loss of income.
Fibromyalgia
A pain disorder in which a person feels widespread pain and stiffness in the muscles, fatigue, and other symptoms.
